Request doesn't fail in Safari if "file not found"

Try sending a request in Safari (I have 3.1) to a file that doesn't exist and the 'exception' or 'failure' events won't fire. But if you ask the XMLHTTPRequest object for its status right after you call the send() method on it in Request.send(), it'll work. Now this obviously isn't an elegant solution...

    this.fireEvent('request');
    this.xhr.send(data);

here--> this.xhr.status;

    if (!this.options.async) this.onStateChange();
    return this;
